Terms of Use - Align'd Wellness

Welcome to Align'd Wellness. These Terms of Use ("Terms") govern your access to and use of the Align'd Wellness mobile application and related services (the "Service"), operated by Scalar Labs ("we," "us," or "our").

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of Service

Align'd Wellness is a personal wellness and period tracking application designed to help you understand your menstrual cycle, track symptoms, log daily check-ins, and receive personalised wellness insights. The Service includes features such as:

Menstrual cycle tracking and predictions
Daily wellness check-ins and scoring
Symptom and mood logging
Cycle phase-aware insights and content
Optional cloud synchronisation across devices

2. Important Medical Disclaimer

Align'd Wellness is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

The Service provides general wellness information and cycle tracking tools for informational and educational purposes only. It should not be used as a substitute for professional medical advice, diagnosis, or treatment.

Do not rely on the Service for medical decisions. Always consult a qualified healthcare provider with any questions about your health, menstrual cycle, or medical conditions. If you are experiencing a medical emergency, contact your local emergency services immediately.

Cycle Predictions

Cycle predictions, fertile window estimates, and ovulation calculations are based on statistical models and your logged data. They are estimates only and should not be used as a method of contraception or for family planning decisions. Individual cycles vary, and predictions may be inaccurate.

Wellness Score

The Align'd Wellness Score is a personalised metric based on your self-reported data. It is designed to help you notice trends and patterns, not to provide a clinical assessment of your health.

3. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have obtained your parent or guardian's consent to use the Service. We do not knowingly collect information from children under 13.

4. User Accounts

You may use the Service without creating an account. If you choose to sign in using Google or Apple, you are responsible for maintaining the security of your account credentials.

You agree to:

Provide accurate information during onboarding and account creation
Keep your account credentials secure and confidential
Notify us promptly of any unauthorised access to your account
Accept responsibility for all activity that occurs under your account

5. Health Data

You understand and agree that:

Health data you enter into the Service (symptoms, mood, cycle data, etc.) is self-reported and its accuracy depends on the information you provide.
The Service stores your health data locally on your device by default. Cloud synchronisation is optional and requires you to sign in.
If you grant the Service access to Apple HealthKit or Google Health Connect, the data accessed is used solely to provide and improve the Service and is never sold or used for advertising.
You are responsible for the accuracy of the health information you provide.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to reverse-engineer, decompile, or disassemble the Service
Interfere with the Service's operation or security
Transmit harmful code, malware, or viruses through the Service
Impersonate another person or misrepresent your affiliation
Use the Service to collect data about other users without their consent
Use automated systems (bots, scrapers) to access the Service

7. Intellectual Property

All content, features, and functionality of the Service — including text, graphics, logos, icons, the Align'd Wellness Score algorithm, and software — are the exclusive property of Scalar Labs and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use, subject to these Terms.

Your health data remains yours. We claim no ownership over the personal or health data you enter into the Service.

8. Third-Party Services

The Service may integrate with or contain links to third-party services, including Google Sign-In, Apple Sign-In, and Supabase. These third-party services are governed by their own terms and privacy policies. We are not responsible for the practices of third-party services.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure.
We do not warrant the accuracy, completeness, or reliability of any predictions, insights, or content provided by the Service.
In no event shall Scalar Labs, its officers, directors, or employees be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or $50, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Scalar Labs and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Termination

You may stop using the Service at any time by deleting the app from your device. If you have an account, you may delete it through the app's Settings screen.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will survive.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms within the app and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

If you do not agree with updated Terms, you should stop using the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scalar Labs regarding the Service and supersede all prior agreements and understandings.
